Terms of Service
These Terms of Service ("Terms") govern your use of the Thrivient creator publishing tool ("Service") provided by Prange Agency LLC ("Thrivient", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service you confirm you meet these requirements.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at admin@thrivienthealth.com of any unauthorized access.
3. Connected social accounts
The Service lets you connect third-party social media accounts (such as TikTok, Instagram, and YouTube) and publish content to those accounts on your behalf. You represent and warrant that:
- You own or are authorized to operate any connected account.
- You will comply with the terms of service, community guidelines, and applicable laws of each connected platform when using the Service.
- Content you publish through the Service does not violate any third party's rights.
You may disconnect any connected account at any time from the Thrivient settings page.
4. Your content
You retain all rights to the videos, captions, and other content you upload or generate using the Service ("Your Content"). You grant Thrivient a limited, non-exclusive, royalty-free license to host, process, and transmit Your Content solely as necessary to operate the Service on your behalf — for example, to publish a video you submit to your connected TikTok account.
5. Acceptable use
You agree not to use the Service to:
- Publish content that violates the terms or community guidelines of any connected platform.
- Spam, harass, defraud, or impersonate others.
- Distribute malware, scrape data without authorization, or attempt to disrupt the Service.
- Publish content you do not have the right to distribute.
6. Fees and subscriptions
Some features of the Service are offered on paid subscription plans. Fees are billed in advance on a monthly or annual basis and are non-refundable except where required by law. You can cancel a paid subscription at any time; cancellation takes effect at the end of the current billing period.
7. Termination
You may terminate your Thrivient account at any time by emailing admin@thrivienthealth.com. We may suspend or terminate your access if you violate these Terms or if your use of the Service threatens platform partners or other users. Sections 4, 8, 9, 10 and 11 survive termination.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that any post published through the Service will reach an audience, generate engagement, or comply with future changes to any connected platform's policies.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVIENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR FOLLOWERS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID THRIVIENT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify and hold harmless Thrivient and its affiliates from any claims arising out of Your Content, your use of the Service, or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of laws principles. The exclusive venue for any dispute shall be the state or federal courts located in Wisconsin.
12. Changes
We may update these Terms from time to time. Material changes will be communicated by email or via a notice in the Service. Continued use of the Service after a change becomes effective constitutes acceptance of the updated Terms.
